Compliance Disclosures
At USA Biz LLC (DBA USA Payments), transparency is part of how we do business.
We believe merchants should understand how payment processing, underwriting, pricing, funding, compliance requirements, and third-party services actually work before making a decision.
The disclosures below provide additional context regarding statements, products, services, and offers referenced throughout the USA Payments website and our marketing materials.
These disclosures should be reviewed together with our Privacy Policy, Terms & Conditions, applicable merchant agreements, and any other agreements provided in connection with a USA Payments solution.
USA Payments’ Role
USA Payments provides merchant services, payment solutions, payment technology, and related support to businesses across a variety of industries.
Depending on the solution selected, payment processing, merchant acquiring, banking, ACH, payment gateway, software, financing, or other services may be provided by third-party processors, acquiring institutions, sponsor banks, financial institutions, technology providers, or other service providers.
USA Payments is not a bank, card network, government agency, or regulatory authority.
Product availability, underwriting requirements, processing terms, pricing, funding schedules, and eligibility requirements may vary based on the provider and the individual merchant.
Where applicable, USA Payments may operate as an independent sales organization, registered agent, referral partner, or authorized representative of third-party payment providers or financial institutions.
Any required sponsor bank, processor, or registration disclosures will be provided where applicable.

A merchant who has previously been declined or terminated by another provider is not guaranteed approval through USA Payments or its partners.
References to improved, higher, or expedited approval opportunities reflect USA Payments’ experience working with specialized industries and multiple processing relationships. Individual results will vary.
Approval Rates and Statistics
Any approval rates, performance statistics, or other numerical results referenced by USA Payments are based on the applicable population, period, eligibility criteria, and methodology used to calculate those results.
Approval rates should not be interpreted as a guarantee that any individual merchant will be approved.
Incomplete applications, businesses operating in prohibited industries, merchants unable to satisfy underwriting requirements, and other ineligible applications may not be included in certain calculations where expressly disclosed.
Past results do not guarantee future outcomes.
Processing Savings
References to potential processing savings, including percentage-based savings claims, represent estimated or historical savings experienced by qualifying merchants under certain circumstances.
Savings are not guaranteed.
Actual pricing and potential savings may vary based on factors including:
- Current processing rates and fees
- Transaction volume
- Average ticket size
- Card type and card mix
- Transaction method
- Interchange qualification
- Industry
- Risk profile
- Equipment or software requirements

- Existing merchant agreement
A merchant’s actual savings can only be reasonably evaluated after reviewing the merchant’s existing processing costs and the proposed USA Payments solution.
Any savings analysis provided by USA Payments is an estimate unless otherwise stated and should be reviewed together with the complete pricing terms presented to the merchant.
Funding Times
References to next-day funding or other accelerated funding schedules apply only to qualifying merchants, transactions, financial institutions, and processing programs.
Funding times may vary based on:
- Processor and acquiring bank
- Merchant risk profile
- Processing cutoff times
- Weekends and bank holidays
- Settlement schedules
- Transaction type
- Reserve requirements
- Risk reviews
- Chargebacks or disputes
- Banking delays
- Compliance reviews
Next-day funding is not available for every merchant or payment solution.
Funding may also be delayed, withheld, or placed under review where permitted under the applicable processing agreement.
Account Stability, Holds, Reserves, and Terminations
USA Payments places significant emphasis on account stability, proper underwriting, transparent communication, and proactive merchant support.
Our goal is to help reduce avoidable disruptions by properly understanding a merchant’s business before placement and helping merchants navigate processor and acquiring bank requirements.
However, no payment provider can guarantee that a merchant account will never experience a funding hold, reserve, risk review, processing limitation, suspension, or termination.
Such actions may be taken by acquiring banks, processors, card networks, financial institutions, regulatory authorities, or other providers based on factors including:
- Transaction activity
- Chargebacks
- Fraud
- Consumer complaints
- Regulatory concerns
- Changes in products or services
- Changes in processing volume
- Changes in fulfillment
- Compliance concerns
- Misrepresentation
- Prohibited activity
- Violation of an applicable agreement
References to account stability or reducing the risk of sudden processing interruptions describe USA Payments’ approach to underwriting, placement, merchant support, and risk management. They should not be interpreted as an unconditional guarantee against future account action.
Dual Pricing, Cash Discount, and Surcharge Programs
Dual pricing, cash discount, surcharge, and similar pricing programs are subject to applicable laws, card-network rules, processor requirements, and program-specific requirements.
Availability and permitted program structure may vary by state, jurisdiction, card type, processor, acquiring institution, and merchant type.
Merchants are responsible for properly operating their selected pricing program, including any required:
- Consumer disclosures

- Receipt disclosures
- Point-of-sale configuration

Merchants should seek independent legal advice when necessary.
PCI DSS and Payment Security
Payment Card Industry Data Security Standard, or PCI DSS, compliance is a shared responsibility.
USA Payments and its processing or technology partners may provide payment technology, compliance resources, security tools, questionnaires, scanning services, tokenization, or other solutions designed to support PCI DSS compliance.
However, merchants remain responsible for understanding and satisfying the PCI DSS requirements applicable to their individual business.
Use of USA Payments or any specific payment-processing solution does not, by itself, make a merchant PCI DSS compliant.
Merchants may be required to complete ongoing compliance validation, security questionnaires, vulnerability scans, or other requirements depending on their environment and processing method.
Healthcare, Pharmacy, Telehealth, MedSpa, and Other Regulated Industries
USA Payments works with businesses operating in healthcare, pharmacy, telehealth, aesthetics, wellness, medical services, and other specialized or regulated industries.
Approval for payment processing does not constitute confirmation that a merchant’s overall business operations comply with applicable federal, state, or local laws.
Merchants remain solely responsible for obtaining and maintaining any licenses, certifications, registrations, prescriptions, authorizations, approvals, policies, and procedures required to legally operate their businesses.
Payment-processing approval should not be interpreted as legal, medical, pharmacy, FDA, DEA, HIPAA, LegitScript, licensing, or other regulatory approval.
Merchants are responsible for ensuring that their:
- Products and services are lawful
- Marketing claims are compliant
- Licensing remains current
- Prescribing and telehealth practices comply with applicable requirements
- Fulfillment practices comply with applicable law
- Data and privacy practices satisfy applicable requirements
- Business operations remain consistent with information provided during underwriting
Changes to a merchant’s business model, products, services, ownership, fulfillment practices, website, marketing, or transaction activity may require additional underwriting review.
Third-Party Services and Partners
USA Payments works with a variety of third-party processors, banks, software companies, financial technology providers, compliance companies, associations, and other service providers.

Third-party services are subject to their own terms, eligibility requirements, pricing, privacy policies, underwriting requirements, and availability.
USA Payments does not control all actions, policies, systems, or decisions made by third-party providers.

USA Payments may reference other payment companies, software providers, card processors, or financial technology platforms for comparative or educational purposes.
All third-party trademarks, brand names, and service marks are the property of their respective owners.
Unless expressly stated, USA Payments is not affiliated with or endorsed by companies referenced for comparative purposes.
Competitor pricing, policies, products, underwriting standards, and service offerings may change over time.
Merchants should independently review the current terms of any payment provider before making a purchasing or processing decision.
